Definitions

For the purposes of this Commute My Kids LLC Privacy Policy (“Policy”):

  • “Affiliate” means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • “Account” means a unique account created for You to access our Service or parts of our Service.
  • “Application” means the Commute My Kids software program provided or made available by the Company downloaded by You through a Mobile Platform’s account to a Device.
  • “Company” (referred to as either “the Company”, “We”, “Us” or “Our” in these Terms) refers to Commute My Kids LLC.
  • Cookies” are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • “Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.
  • “Drivers” means drivers of vehicles who provide transportation for children (“Riders”) to and/or from designated locations for the agreed upon dates of Service as scheduled by Users.
  • “Feedback” means feedback, innovations or suggestions sent by you regarding the attributes, performance or features of our Service.
  • “Mobile Platform” means a platform operated by a third party (e.g., the “App Store” operated by Apple, or “Google Play” operated by Google), where you may access and download the Application to your Device.
  • Personal Data” is any information that relates to an identified or identifiable individual.
  • “Service” refers to products and services we provide you through the Website or Application.
  • Service Provider” means any natural or legal person who processes the data on behalf of the Company. It also refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
  • Website” refers to Commute My Kids LLC accessible from commutemykids.com.
  • “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Introduction

We respect your privacy and are committed to protecting it through our compliance with this policy. This policy describes (a) the types of information we may collect from you or that you may provide when you visit the Application, and (b) our practices for collecting, using, maintaining, protecting, and disclosing that information.

This policy applies to information we collect:

  • On the Website.
  • Thorough the Application.
  • In email, text, and other electronic messages between you and the Website or you and the Application.
  • When you interact with our advertising and applications on third-party websites and services if those applications or advertising include links to this policy.

Except as otherwise provided in this policy, it does not apply to information collected by:

  • Us offline or through any other means, including on any other website or application operated by Company or any third party; or
  • Any third party, including through any application or content (including advertising) that may link to or be accessible from or on the Application.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the Application. By accessing or using the Application, including, without limitation, by providing us with personal information to complete a transaction, verify your credit card, or place an order, you agree to this privacy policy and consent to our collecting such information. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Application after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

You also acknowledge and agree that your access to and use of the Application is subject to our Terms of Service and any conflict between this policy and the Terms of Service will be determined in favor of the Terms of Service.  You also acknowledge and agree that we are not responsible for how third-parties, vendors, and Service Providers collect or use your information.

Capitalized terms used in this policy, and not otherwise defined, will have the same meaning as in our Terms of Service.

Children Under the Age of 13

Our Website is not intended for children under 13 years of age. No one under-age 13 may provide any information to or on the Application. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on the Application or through any of its features, register on the Website or Application, make any purchases through the Application, use any of the interactive or public comment features of the Application, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information. Personal information we collect

This Policy applies to:

  • Riders: those who receive transportation and related services from Company.
  • Users: those with an Account who request or schedule transportation and related services for Riders from Company.

We also collect data created during use of our Services, including: 

  • Location data: We collect precise and approximate location data from drivers’ and mobile devices when the Application is running in the foreground (Application open and on-screen) or background (Application open but not on-screen).
  • Precise and/or approximate location information from riders’ mobile devices if they enable us to do so via their device settings.
  • We collect the above location data during use of our Services from the time transportation and related services are requested until it is finished, and any time the Application is running in the foreground (Application open and on-screen).
  • Transaction information related to the use of our Services, including the type of Services requested or provided; trip or order details (such as date and time, requested pick-up and drop off addresses, distance traveled; and payment transaction information (such as amount charged, and payment method). We also associate a user’s name with that of anyone who uses their promotion code.
  • Usage data about how users interact with our Services. This includes access dates and times, Application features or pages viewed, browser type, and Application crashes and other system activity.

When you use the Application, we automatically collect certain information about your Device, including information about your web browser, IP address, time zone, and some of the Cookies that are installed on your Device. Additionally, as you browse the Application, we collect information about the individual pages or features of the Application that you view, what websites or search terms referred you to the Application, and information about how you interact with the Application. We refer to this automatically collected information as “Device Information”.

We collect Device Information using the following technologies:

– “Cookies”. For more information about cookies, and how to disable Cookies, visit http://www.allaboutcookies.org.


– “Log files” track actions occurring on the Application, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.


– “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Application.

How do we use your Personal Information?

We use the data we collect:

1. To provide our Services. We use data to provide, personalize, maintain, and improve our Services.

This includes using data to:

  • create/update Accounts.
  • enable transportation and related services, and other services/features, such as:
  1. calculating prices and fares, including using location data and trip details (such as requested pick-up and drop off addresses). We may also consider non-personal data or factors, including date and time, estimated distance and time, minimum base fares, tolls, taxes and fees, and surge pricing
  2. process payments.
  3. personalize Users’ accounts. facilitate insurance, invoicing, or financing solutions.
  4. perform necessary operations to maintain our Services, including to troubleshoot software bugs and operational problems.

We perform the above activities on the grounds that they are necessary to fulfill the terms of our agreements with Users, are compatible with such uses, or are necessary for purposes of our and our Users’ legitimate interests.

2. Safety, fraud protection and security. We use data to help maintain the safety, security, and integrity of our Services and Users. This includes:

  • verifying Users’ accounts, identity or compliance with safety requirements.
  • in the United States, we may also perform Rider identity verification using names, date of birth, emails, telephone numbers, and payment information, to help deter use of our Services by fraudulent accounts.
  • we also require verification of User identity and/or age to use payment methods such as cash, to prevent fraudulent use of identification photos, or to prevent Users from creating multiple accounts.
  • using Account, Device, location, usage, transaction, wireless carrier, and other data, including communications between Users and metadata, to prevent, detect, and combat fraud. 
  • using reported incidents, User ratings, and other feedback to encourage safe use of our platform and compliance with our terms.
  • using Rider data (such as account information, cancellation and reported incident rates, current pick-up and drop-off location, past trip information, and ratings information) to predict and help avoid pairings of Users that may result in increased risk of conflict.
  • We perform the above activities on the grounds that they are necessary to fulfill the terms of our agreements with Users, and/or for purposes of the legitimate safety and security interests of our users and members of the general public.

3. Customer Support. We use the information we collect (which may include call recordings, chat logs, in-Application audio recordings) to provide customer support, including to investigate and address User concerns and to monitor and improve our customer support responses and processes.

We perform the above activities on the grounds that they are necessary to fulfill the terms of our agreements with Users or for purposes of our  legitimate interests in monitoring and improving our customer support services.

4. Research and development. We use data for analysis, machine learning, product development, research, and testing. This helps us make our Services more convenient and easier-to-use, enhance the safety and security of our Services, and develop new services and features.

We perform the above activities on the grounds that they are necessary for purposes of our legitimate interests in improving and developing new services and features.

5. Enabling communications between Users and Drivers. For example, a Driver may message or call a Rider to confirm a pick-up or drop-off location, or a Rider may call a Driver to retrieve a lost item.

We perform the above activities on the grounds that they are necessary to fulfill the terms of our agreements with Users.

6. Marketing and Advertising. We use data to market our Services.

This includes using this data to:

  • send emails, text messages, push notifications, and in-Application messages or other communications marketing or advertising our products, Services, features, offers, promotions, sweepstakes, news and events.
  • display personalized advertising on third party apps or websites. 
  • display third party advertising in our Application or in connection with our Services.

We perform the above activities on the grounds that they are necessary for purposes of our legitimate interests in informing Users about our Services and features.

7. Non-marketing communications. We may use data to send surveys and other communications that are not for the purpose of marketing our Services. We may also send users communications regarding elections, ballots, referenda, and other political processes that relate to our Services.

We perform the above activities on the grounds that they are necessary to fulfill the terms of our agreements with users, or for purposes of our, and our users’, legitimate interests in informing users about events that may have an impact on their use of our Services.

8. Legal proceedings and requirements. We use data to investigate or address claims or disputes relating to use of our Services, to satisfy requirements under applicable laws, regulations, operating licenses or agreements, insurance policies, or pursuant to legal process or governmental request, including from law enforcement.

9. We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Application (for example, by generating analytics about how our customers browse and interact with the Application, and to assess the success of our marketing and advertising campaigns).

Sharing your Personal Information

a. Third Party Service Providers

We share your Personal Information with third party service providers to help us use your Personal Information, as described above, and to help us understand how our customers use the Application.

In general, these third party service providers will only collect, use, and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies with respect to the information we are required to provide to them for your purchase-related transactions. For these third party service providers, it’s mandatory that you read their privacy policies so you can understand the manner in which your personal information will be handled.

Remember that certain third party service providers may be located in, or have facilities that are located in, a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party, then your information may become subject to the laws of the jurisdiction(s) in which that third party service provider or its facilities are located.

Once you leave our Application or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Website’s Terms of Service.

When you click on links on our Application, they may take you away from our Application. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

b. Emails

We reserve the right to share emails between connected Users on the Application. All Users agree to share their emails with us.

c. Postal addresses

We may access a user’s personal postal address information only if the User has agreed to share their personal address with other Users. 

d. Applicable Laws and Regulations

Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.

Behavioral Advertising.

We may maintain a presence on third-party social networking sites such as Facebook, LinkedIn, X (Twitter), and others. We do not control, and are not responsible for, the collection, tracking, use, or disclosure of your information (including your Personally Identifiable Information) gathered through social networking websites and applications, including through our Application within other applications, or otherwise as a result of your participation in social networking sites. Third-party social networking applications and advertisers on these applications, including on the Application pages within these sites, are not obligated to follow or apply this policy or our Website’s Terms of Service.  If you have any questions about an advertisement or other targeted content, you should contact the responsible social networking provider directly and refer to the applicable privacy policy and terms of use of that social networking provider.

As described above, we may use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Cross-Device Tracking.

Functionality within our Application may permit you to roam and access services, preferences, and content across your computing devices from phones to tablets. Rather than residing as a static software program on your device, key components of the Application are cloud-based, updated periodically, to provide you with the latest improvements and features. In order to provide this experience, we collect data about you, your device, and the way you use our Application. 

Do Not Track.

Please note that we do not alter our Application’s data collection and use practices when we see a Do Not Track signal from your browser.

Changes.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons.

Accessing and Correcting Your Information.

You can review and change your Personal Information by logging into the Website or Application and visiting your Account profile page. You may also send us an email at support@commutemykids.com  to request access to, correct or delete any Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your User account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Data Security.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website or Application, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. We urge you to be careful about giving out information in public areas of the Website or Application, if any. The information you share in such public areas may be viewed by any User of the Website or Application.

Your credit card data is stored through a PCI-compliant payment gateway service data storage. They store your data on a secure server behind a firewall. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands including Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our Website or Application and its Service Providers.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to our Application. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Application.

Changes to Our Privacy Policy.

It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Website or Application home page. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our Website or Application and this Privacy Policy to check for any changes.
